What is DMCA Safe Harbor?

Enacted in 1998, Title II of the Digital Millennium Copyright Act (17 U.S.C. § 512) establishes legal "Safe Harbor" protections for Online Service Providers (OSPs). Under these provisions, platforms that host user-uploaded content are protected from direct copyright infringement liability, provided they satisfy specific statutory conditions:

  4. Repeat Infringer Policy: The platform must adopt and reasonably implement a policy providing for the termination of user accounts belonging to repeat infringers.
